Overview

This website is operated by Sterlings Wild West Foundation. Throughout the site, “we,” “us,” and “our” refer to the Foundation. By visiting our website, making a donation, or using our account and fundraising services (the “Service”), you agree to these Terms of Service. These Terms apply to visitors, donors, account holders, sweepstakes participants, and contributors of content.

We accept one-time and recurring charitable donations. We do not sell merchandise or promise physical products or digital downloads in exchange for donations.

Website Use

You must be legally able to authorize any donation or recurring payment you make. Sweepstakes participation is subject to the age, residency, and other eligibility requirements in the applicable Official Rules.

You may not use our website or services for any illegal or unauthorized purpose. A breach of these Terms may result in termination of access, subject to applicable law.

General Conditions

We may refuse or limit use of the Service, including for suspected fraud, abuse, or violations of these Terms, subject to applicable law and the applicable Official Rules. Any payment error or unauthorized charge will be handled under our Refund Policy.

You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission.

Donations and Tax Treatment

Donations support the Foundation's charitable mission. Eligible donations receive giveaway entries as described in the applicable campaign materials and Official Rules. A donation does not guarantee a prize, merchandise, or any other product.

Any complimentary digital materials we may offer are optional and are not guaranteed with a donation. There are no product shipments, exchanges, or merchandise-delivery obligations associated with donations.

Sterlings Wild West Foundation is a federally recognized 501(c)(3) nonprofit organization. Donations are tax-deductible to the extent permitted by law. Each donor's eligibility for a deduction depends on applicable law and individual circumstances. Retain your donation records and consult your tax adviser about your own return.

Donation Authorization and Billing

You authorize the donation amount and, if selected, recurring billing frequency disclosed at checkout. You agree to provide current, complete, and accurate contact, account, and payment information and to use only a payment method you are authorized to use.

We may correct inaccurate website information. If we make a payment-processing error or identify an unauthorized charge, we will review and resolve it under our Refund Policy. We will not treat an error as authorization for a different donation amount.

Giveaway Participation

We conduct successive vehicle giveaway campaigns and weekly mini giveaways. Each giveaway is governed by its own Official Rules, including eligibility, entry methods, entry periods, entry allocations, drawing procedures, winner requirements, and prizes. No purchase or donation is necessary to enter or win. A free alternate method of entry is available as described in the applicable Official Rules. A donation does not guarantee a win.

By participating, you agree to the applicable Official Rules. Those rules control if there is a conflict concerning sweepstakes participation. These general policies do not change a campaign's rules, extend an entry deadline, or carry expired entries into a later campaign.

Fraud, manipulation, or abuse of an entry system may result in action under the applicable Official Rules. Good-faith reports of payment errors or unauthorized charges are not, by themselves, fraud or abuse.

Payments, Chargebacks, and Fraud

Donations are nonrefundable except for an error made by us, an unauthorized charge, or where required by law. Contact hello@sterlingswildwest.com promptly if you believe a charge was erroneous or unauthorized. See our Refund Policy.

Nothing in these Terms limits your lawful right to dispute an unauthorized charge. Fraudulent donations or deliberate abuse may be investigated, and entry eligibility will be addressed under the applicable Official Rules and by the sweepstakes administrator. We do not automatically treat every payment inquiry or good-faith dispute as grounds for a permanent ban.

Recurring Donations

Recurring monthly donations are billed automatically for the amount and frequency authorized at checkout until canceled. They continue across successive giveaway campaigns; the end of a campaign does not end the recurring donation.

To cancel, log in to your account and complete cancellation before the next scheduled charge. Emailing us does not itself cancel the recurring donation or guarantee that we can stop an upcoming charge.

Cancellation stops future recurring charges but does not reverse a charge already processed, including a charge processed earlier on the same day. Valid entries associated with completed donations remain subject to their applicable Official Rules. There are no prorated refunds for partial billing periods, subject to the exceptions in our Refund Policy.

Intellectual Property

Content on this site—including designs, logos, graphics, digital materials, and branding—is owned by Sterlings Wild West Foundation or its licensors and may not be used, reproduced, or distributed without permission, except as permitted by law.

Third-Party Services

We use third-party providers, including Shopify, for website hosting, payment processing, account services, and related functions, and work with sweepstakes administrators and prize-fulfillment providers as applicable. These providers may have their own terms and privacy policies.

To the extent permitted by law, we are not responsible for delays, errors, or failures caused by third-party services. This does not limit our obligations under applicable law or our policies concerning payment errors and unauthorized charges.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for any damages arising from:

  • Use of our website or services

  • Participation in promotions or giveaways

  • Delays, interruptions, or technical failures

Your use of the Service is at your sole risk.

Termination

We reserve the right to terminate or suspend your access to our Services at any time, without notice, for any reason, including violation of these Terms.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Utah.

Dispute Resolution

By using this site, you agree that any disputes will be handled individually and not as part of any class action.

To the extent permitted by law, disputes may be resolved through binding arbitration rather than in court.

Changes to Terms

We reserve the right to update, change, or replace any part of these Terms at any time.

It is your responsibility to check this page periodically for changes.
